Orders to book Inspector Balwinder Kaur, photojournalist Brijesh Kumar and cameraman Ravi
Chandigarh/Ludhiana, September 6, 2012: Punjab Government today ordered for registration of FIR under Section 306 IPC for abetment of suicide of Shivali against inspector Balwinder Kaur, photojournalist Brijesh Kumar and cameraman Ravi.
In a communication to the Commissioner of Police, Jalandhar, the Department of Home Affairs and Justice under the signatures of Principal Secretary Home has said; “An unfortunate incident occurred on the 30th of August 2012 in Jalandhar when a student of SD College for Girls Shivali committed suicide because of harassment by Inspector Balwinder Kaur in the presence of media persons.
The matter has been enquired into by Gurpreet Deo, Inspector General of Police, Zone-II, Jalandhar who has concluded that the child committed suicide because of her belief that there was no way to prevent her pictures from being published next day. In her opinion the Police and Media have to share the blame in this case and are required to be held accountable to the law of the land. As the I.G. has pointed out if a little compassion and understanding had been shown by either of them, the young girl may have been alive.
Shivali ended her life within the space of half an hour of the incident. The statement of Ram Pal S/O Jagat Ram Driver of the Train No. 64552 down recorded by the I.G.P. has ruled out the possibility of an accident in this case. A copy of the enquiry report submitted by the Inspector General of Police, Zone II, Jalandhar is enclosed.
The matter has been examined and it has been decided that suitable disciplinary action against the Inspector Balwinder Kaur for her general misconduct and specifically misconduct in the present instance be initiated.
The opinion of the Ld. Advocate General Punjab has been obtained and it has been decided that an FIR under provisions of Section 306 IPC for abetment of suicide of Shivali against Inspector Balwinder Kaur, photojournalist Brijesh Kumar and Cameraman Ravi may be registered.”
