Chandigarh, July 20, 2015: The Punjab government today strongly reacted to sudden repatriation of teachers of Punjab on deputation in Chandigarh despite clear assurance of administrator and called upon UT administration to immediately take back the orders of repatriation as this order was indicative of deputing the claim of Punjab on Chandigarh.
In a strongly worded letter, Punjab Education Minister Dr Daljit Singh Cheema today pointed out that repatriation of teachers on deputation in U.T. to Punjab has sent shock waves amongst the people of state because deputation to Chandigarh is not a normal deputation as this deputation was under the purview of Punjab Reorganisation Act to maintain 60:40 rights of Punjab and Haryana. He pointed out that the position of deputation in UT is different as they do not get any deputation allowance. Moreover, employees on deputation have the right to serve in the UT as it is the Capital of Punjab and Haryana.
Dr Cheema regretted that UT administration had deliberately chosen to ignore the assurance given by his excellency Prof Kaptan Singh Solanki, Governor Punjab and Haryana and administrator of Union Territory of Chandigarh who after listening to plea made by a delegation of Punjab Member of Parliaments led by Mr Sukhdev Singh Dhindsa had stalled the repatriation move terming it illogical. He said that it was strange that after giving assurance by the U.T. administration not to repatriate the teachers on deputation, the Chandigarh Administration has recently repatriated some teachers.
Dr Cheema said that by doing so, Chandigarh Administration was discouraging the employees coming on deputation from Punjab for short period. Protesting against creation of UT cadre in violation of Punjab Reorganisation Act, Dr Cheema pointed out that though in the spirit of reorganization all employees were to be taken on deputation in the ratio of 60:40 from Punjab and Haryana, but without consulting State, the U.T. established its own cadre causing great damage to the interest of States. He said that it was travasity of justice to both partner states that as per the new policy of Chandigarh Administration, 80% post have been already gone to the U.T. pool and only 20% post are left for States. The Education Minister said that to rub salt on the already simmering wounds of Punjab, now out of meagre 20% of the total strength has to be filled by deputation in the ratio of 60:40 from Punjab and Haryana. Giving the factual position, he said that even if we go by this formula started by U.T. whereby it has left only 20% seats to the State of Punjab & Haryana in the ratio of 60:40, there is a great shortfall in the number of posts of teachers which should have been taken on deputation to the U.T.
Dr Cheema, in the communiqué had graphically pointed out the failure of UT administration to maintain 12% quota out of 20% quota of deputation from Punjab in all the 16 subjects. He said that in the case of Social Studies, against the rightful quota of 74, there are only 47 teachers from Punjab whereas in the case of English, there are only 3 teachers against the quota of 9. Similarly, in Science (Non Medical) nthere are only 10 teachers of Punjab against a quota of 42. Similarly in the case of Maths, there are 9 teachers of Punjab against a quota of 16 and one teacher of Music against quota of 7. In the case of DPE, there was only 1 teacher from Punjab against quota of 18 and in the case of Fine Arts and Home Science, there was not a single teacher against a quota of 24 and 9 respectively. In the case of Hindi, there was a shortfall of 6 and in Punjabi a shortfall of 4 and in Sanskrit, a shortfall of 11 teachers. He regretted that out of total legitimate quota of 295, UT administration has only 156 teachers on deputation showing a great bias against the state of Punjab. Similarly in the case of JBT teachers, there were only 115 teachers against quota of 167 and in the case of lecturers, there were 51 lecturers from Punjab against quota of 66 lecturers. In the case of heads of schools, there were only 2 from Punjab against quota of 5 and similarly in case of Principals, there were only 4 from Punjab against quota of 6.
The Education Minister pointed out that the above detailed position gives an ample evidence to show that there was no need to repatriate any of the employees of Punjab Cadre on deputation with the U.T. He said that UT administration rather than repatriating teachers should launch a drive to induct more teachers from Punjab to maintain the prescribed quota.   He further clarified that there was no question of replacement of already working teachers on deputation and more staff should be taken on deputation against the vacant posts of the quota of state. He said that moreover, the process of rationalisation and transfer was over in the State of Punjab and there was no vacancy nearby Chandigarh to adjust these teachers. It will cause dislocation of families of such teachers. He cautioned that before taking decision regarding employees working on deputation in Chandigarh, State of Punjab and Haryana must be consulted so that right decision may be taken.
The Punjab Education Minister warned that repatriation of staff on deputation to Chandigarh would cause unrest in the state. He said that this hasty step by UT administration would cause indirect indication of diluting the claim of Punjab state on Chandigarh.
He asked the UT administration that keeping in view the above position, no employees on deputation to Chandigarh Administration should be repatriated and the teachers already repatriated may be taken back immediately to give justice to the state of Punjab.
