Delhi HC orders FIR against two doctors, woman over forgery

New Delhi, May 5 (IANS) Expressing shock over the abuse of court process for getting interim bail, the Delhi High Court Monday ordered registration of FIR against two doctors and a woman who used fabricated medical reports to secure bail.

The court asked Delhi Police to lodge a criminal case against the accused for forgery, cheating and impersonation.

A division bench of Justice Kailash Gambhir and Justice Sunita Gupta said: "It is a matter of great shock that for seeking interim bail on medical grounds, to what extent the court process has been abused."

The court's order came while hearing a plea of Bijender, who sought three months interim bail to take care of his ailing wife Pinki, who has developed a cyst in her right ovary.

The bail application was annexed with an ultrasound report of Pinki which was issued last year by a doctor named Anand Swaroop who runs a firm called Anand Ultrasound.

Filing a status report in the case, police said Pinki was advised by a man named K.P.S. Jain, who claimed to be a doctor, to get the ultrasound done from Anand Ultrasound.

However, the police report said Jain was an "imposter" and his real name was K.P.S. Nain.

It was further revealed that the man called K.P.S. did not even have a degree of M.B.B.S. or M.D. but had a degree in homeopathy.

Swaroop during investigation said the ultrasound report of Pinki was not issued by him and the serial number mentioned in the report was fake because as per his records, the entry number was in the name of someone called Pushpa Devi.

The court also issued show cause notice to K.P.S. for contempt of court by not disclosing his correct identity and maintaining his stand of being "Doctor K.P.S. Jain" (instead of K.P.S. Nain) when he appeared before the court March 13, 2014.

It further directed police to properly probe into the role of Anand Swaroop and also to take steps to ensure that the imposter (K.P.S.) does not run any clinic under any other name.

The court, seeking a fresh status report on steps taken, posted the matter for May 23.
