New Delhi, August 17, 2014: The Haryana Cabinet at Chandigarh today approved the Policy for allotment of Government land for Social, Religious, Charitable Trusts or Institutions for construction of places of worship, Dharamshala,  Janj Ghar or Community Centre etc.
As per the policy, the applicant should be a registered legal entity for example, a Society registered under the Haryana Registration and Regulation of Societies Act 2012; a Trust registered under the Indian Trust Act or a Not-for-Profit company registered as such under the Indian Companies Act. The Government would consider allotment of land only at places where the Government land is available and can be spared for the purpose after meeting the Government needs. This policy does not in any manner create a right in anybody to demand allotment of land for the said purposes.
The Government would allot the sites only where the access to such Community sites is from a 15 meters wide road so as to ensure that the access to the site is congestion-free. The Government land may be allotted on lease hold basis on payment of upfront Lease Premium and, thereafter, payment of annual lease rentals as per the scale given below:

The applicant Society would be required to execute an Agreement with the concerned Deputy Commissioner containing the terms and conditions of lease grant and use of the site. No person would be denied the use of the facility created on the allotted site on grounds of religion, caste or creed. The buildings for the facility would be constructed after getting the building plans approved from the competent authority. Proper Parking arrangements would be made by the allottee agency. The site would be used only for the purpose for which it is allotted and any violation may entail resumption of the site by the Government without payment of any compensation to the allottee Society or Agency. The allottee agency would at all times maintain the facility and the surrounding area in good and clean condition and fit for public use.
The allottee would be required to make the facility operational within a period of 5 years from the date of offer of possession of the site, which may be extended further for a period not exceeding two years. The extension would be permissible only where construction of the facility is under substantial progress at the time of completion of 5 years. Wherever the site remains unutilized for a period of 5 years from the date of offer of possession, the site would be liable to be resumed.
The annual lease rentals would be payable by March 31 of the year for the Calendar Year Any delayed payment would attract interest at the rate of  15 per cent per annum on the amount of default for the period of default. Non- payment of the annual lease rentals by December that is before the close of the Calendar Year may entail resumption proceedings.
The Cabinet also approved the exchange of shamilat land measuring 1 kanal 10 marla of Gram Panchayat Khaika, Block Sohna, district Gurgaon with private companies land measuring two kanal two marla.
Gram Panchayat Khaika passed a resolution to this effect as the passage passes through the land of companies. After this, this passage would be on one side of the companies land.
The Cabinet also approved the exchange of shamilat land measuring 113 kanal 16 marla of Gram Panchyat Ullawas, Block Sohna, district Gurgaon with that of private companies land measuring 113 kanal 16 marla.
Gram Panchayat Ullawas had passed a resolution for exchange of its land in shamilat deh as this land of passages and  nullahs are of no use for the inhabitants of village and the said land is surrounded by the land of these private companies.
The exchange of land will be subject to condition that companies will provide access to the lands of individuals, if any, approachable by these passages and further also proide access to all the remaining Panchayat land, especially the land situated on the right side of Khasra No.13/10, 11 and 20 and entry in the revenue record to this effect.
