Ludhiana, October 15, 2013: Punjab Tax Bar Association (PTBA) said that by imposing Advance Tax in place of Entry Tax the Excise & Taxation Department has indirectly acted against the order passed by Punjab & Haryana High Court which granted stay against recovery of Entry Tax. According to Ashok Kumar Juneja, President and B.R. Kaushal, Secretary General (PTBA) It has been imposed without consulting the professionals, dealers and industrialists.

In a joint statement here on Tuesday, they said that VAT is imposable on the goods when it is purchased/ sold and not in advance. Notification itself is unconstitutional. Exemption Certificates from Advance Tax should issued at the level of Designated Officers or AETC who are also responsible authorities and not by DETC since it will cause delay due to lengthy process. Advance Tax which is to be deposited at Information Collection Centers should also be accepted by demand drafts. The department should held meetings with concerned professionals, bar members, dealers and industrialists to have their view and till then the Advance Tax provisions should not be invoked in state. www.cityairnews.com
