A deputation of Punjab Pradesh Beopar Mandal (PPBM) today met DETC Ludhiana Randhir Kaur, regarding the door-to-door inspection and OTS Scheme for pending VAT case notices.

Ludhiana, May 26, 2023: A deputation of Punjab Pradesh Beopar Mandal (PPBM) today met DETC Ludhiana Randhir Kaur, regarding the door-to-door inspection and OTS Scheme for pending VAT case notices. 

Giving this information here, Sunil Mehra (State General Secretary, PPBM), Parveen Goel (Ludhiana District President PPBM), Ayush Aggarwal (Ludhiana District General Secretary, PPBM), Pawan Lehar (District Chairman PPBM) added the DETC assured that the ongoing drive by the department is only against suspicious dealers whose credentials are being checked and verified. She categorically told the deputation that there is no penalty if there is no display of GST number in the premises etc.  
Further, the PPBM leaders said they have also been asked by the DETC that if any taxation officer harass the dealers, then she should be informed immediately. 

The PPBM leaders added the DETC also assured that no illegitimate action will be undertaken by the inspection officers.
The PPBM leader apprised the DETC that some of the inspection officers are threatening to impose a fine of Rs.50000 on dealers who are not showing details such as GST number etc on boards in their respective premises. However, the DETC categorically told the deputation that the inspection drive is not about compliance with the guidelines but about suspicious dealers, said the PPBM leaders. They said they have given some names of the departmental officials to the DETC who are allegedly misusing their powers and penalising the dealers without any solid reason. 

The deputation also asked for the pending GST refunds for the period of 2017-2020 where the assessees have to earlier manually file the GST ITC. Any assessee who made mistake in filing the returns manually or missed certain ITC to manually reflect in GST3B, they can acknowledge the same to the concerned ATC or file an application with the department and their pending ITC shall be cleared after due diligence.

The DETC has also assured that the VAT pending cases will be settled soon, said the PPBM leaders.

Gurmeet Singh Kular (FICO President) was also included in the deputation, said GST department must find a certain alternative way to deal with the non-filing of GST returns by seller as for current situation genuine buyer, who pays all the amount and tax after getting bill, is harassed by the department. And he requested the DETC to recommend the Central GST on finding a fluent way to re-activate the suspended GSTIN after the assessee has undertaken all the necessary norms. DETC Ludhiana assured that the alternative way to deal with these situations will be assessed and department is working daily to simplify the process and make it easy for the assessees. 

A memorandum was also submitted to DETC, Ludhiana.

The deputation was comprised among others of Sanjay Gupta, Ravi CA Taxation, Om Parkash Bhardwaj CA IT & Taxation, Tajinder Singh, Adv Munish Ahuja, Adv Amit Gupta, Ramesh Mahajan, Pawan Bhardwaj, Kewal Kishan Gupta, Sanjeev Kumar Kundra, Rohit Gupta, Ved Parkash, Shekhar Gupta, Gurcharan Singh, Pawan Malhotra.

Meanwhile, the PPBM leaders said they also preparing a list of corrupt officials of the department which will be soon given to all the DETCs of the state and also to Punjab CM Bhagwant Mann and the Union Finance Minister Nirmala Sitharaman further suitable action.
