Most cases can be settled by mutual consent and mediation: Chief Justice HP High court

Dharamsala, September 25, 2022: Chief Justice of Himachal Pradesh High Court Justice Amjad A. Syed has said that settlement of most cases can be possible through mutual consent and mediation, which will reduce the number of cases in courts while ensuring easy and timely justice to the people. He expressed this view while presiding over the Legal Services Maha Shivir organized under the aegis of National Legal Services Authority NALSA, New Delhi and State Legal Services Authority at Dharamsala on Sunday.

Justice Uday Umesh Lalit, Chief Justice of India was to be the chief guest at the event. He was to be accompanied by Union Law Minister Kiren Rijiju and Supreme Court Judge and NALSA executive chairman Justice DY Chandrachud. All three of them were unable to reach the venue due to heavy rain in Himachal. In the CJI’s absence, Himachal Pradesh High Court Chief Justice A A Sayed presided over as the chief guest at the event in Dharamshala on Sunday.

 

Chief Justice Amjad A. Syed said that the ultimate goal of law is to establish peace and brotherhood among all sections of the society and it is the fundamental right of every citizen to get justice. He said that the basic objective of such camps is to create literacy and awareness about justice among the people. Apart from this, people have to be made aware about various aspects of law through general dialogue and to make decisions through conciliation and agreements.

 

Chief Justice Amjad A. Syed said that the settlement of one crore cases was ensured by mutual consent through Lok Adalats organized by NALSA in the country in August last month. Out of which a total number of  48 thousand cases were received in Himachal Pradesh and  of these 24 thousand cases were disposed of and a fixed amount of Rs.69 crore was paid.

 

State High Court Judge Justice Sabina while expressing her views said that a special campaign has been started to identify the eligible people for providing legal aid along with providing information about the works of the Legal Services Authority to every household through Para Legal Volunteers, under which more than 1500 people have been identified for legal aid by contacting 39231 people so far.

 

State High Court Judge Justice Vivek Thakur also threw light on various legal aspects. He said that the disposal of crores of cases has been ensured through Lok Adalats, in which the people get quick justice due to the mediation of the courts, where the number of cases in the courts has also been decreased.

 

Member Secretary, National Legal Services Authority, Ashok Jain informed that full time Legal Aid Defence Councils are being appointed in 365 districts of the country, out of which 6 districts of Himachal Pradesh have been included and Kangra district is one of them.

 

On this occasion, benefits were provided to 10 beneficiaries of various schemes of the state government by the chief guest. District and Sessions Judge, Kangra Ajay Mehta thanked the chief guest and all the guests.

On this occasion, State High Court Judge Justice Sushil Kukreja, Justice Virendra Singh, Justice Satyen Vaidya, Solicitor General Balram Sharma, Registrar General Arvind Malhotra, Advocate General Ashok Sharma, District and Sessions Judge Ajay Mehta, High Court Bar Council President Ajay Kochar , Bar Association President Lavnish Sharma, District Legal Services Authority Member Secretary Vijay Lakshmi, Deputy Commissioner Dr. Nipun Jindal, District Administration and Police Administration Officers, Advocates, Panchayat Representatives were present .
