CBI files supplementary chargesheet against five accused for alleged fake encounter of Ishrat Jahan and three others

New Delhi/Jalandhar, February 6, 2014:  The Central Bureau of Investigation has today filed a supplementary chargesheet against the five accused persons before the ACJM, CBI Court No 2, Mirzapur, Ahmedabad (Gujarat). The four accused persons charged are the then JD SIB Ahmedabad U/s 120-B, 302, 346, 364, 365, 368 of Indian Penal Code & U/s 3, 25(a) (a), 27 & 29 of Arms Act and three then ACIO’s of SIB Ahmedabad U/s 120-B, 346, 365, 368 of Indian Penal Code. One more accused person (the then official of Gujarat Police) already chargesheeted on July 3, 2013 in this case, has also been charged U/s 193 of Indian Penal Code.
The instant case was registered by the CBI on December 16, 2011 in compliance of the orders of the High Court of Gujarat It was alleged that accused officials of Gujarat Police and certain other persons were instrumental in securing illegal custody of the four persons who were subsequently abducted and later killed in a fake encounter. The persons killed were kept in illegal custody separately before the alleged fake encounter. The CBI had earlier filed charge sheet on July 3, 2013 in the Designated Court at Ahmedabad against then 07 officials of Gujarat Police U/s 302, 364, 368, 346, 120-B, 201, 203, 204, 217, 218 of IPC and Section 25(1)(e), 27 of Arms Act
CBI had sought permission from the Court as per the provisions of section 173(8) of Cr.P.C. and continued further investigation to look into the other aspects of the offence.
After thorough investigation based on facts & circumstances, CBI filed a supplementary chargesheet today (on February 6, 2014). The Court has accepted the Chargesheet.
The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it.  Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
