Chandigarh, October 3, 2012: The State Consumer Disputes Redressal Commission, Punjab has directed to Mittal Nursing Maternity, Ludhiana to pay Rs. 50 thousand as compensation for deficiency in services.

Disclosing this here today the spokesman of Punjab government said that Jeewan Chhibbar resident of Ludhiana had filed the complaint that his wife Rajni Chhibbar was pregnant and had been getting treatment from Mittal Nursing Maternity, Ludhiana. Due to some complications doctors decided to conduct a delivery through caesarean on expecting date regarding for which some documents were got signed from the complainant and his wife. However the doctors could not arrange anesthetist and pediatric doctors and the caesarean could not be performed. He said that the contention of the complainants is that the trauma could have ill effect on the fetus and the caesarean section was considered a saver alternative for delivery but the Mittal Nursing Maternity even after knowing that without caesarean, the delivery was not possible and the life of the complainant's wife and child was in danger did not shift the patient to some other hospital. After that the child was born in severe critical condition, it was noticed that there was less supply of oxygen to the brain immediately before the birth of the baby causing severe damage to the brain. At that time the patient was shifted to Cheema Medical Complex, Mohali immediately. The doctors told that the child may hardly survive and would be mentally retarded and physically handicapped.

He said that due to the negligence of the nursing home the mother has suffered mentally and physically and their child has become mentally retarded and physically handicapped, due to the damage to the brain. The Commission noted that child died within a few days and it was the first child of the couple.

The spokesman further said that after hearing both the parties the Commission found negligence from the side of Mittal Nursing Maternity, Ludhiana and was asked to pay Rs. 50 thousand as compensation for deficiency in services.
